3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years old to use BlinkPost. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and truthful
• You will maintain the accuracy of your account information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains current

4. Subscription Plans and Pricing

4.1 Subscription Tiers

BlinkPost offers the following subscription plans:

• Free: Limited features, up to 2 posts per month
• Pro: Advanced features, up to 30 posts per month
• Agency: Full features, up to 120 posts per month, priority support

4.2 Billing

• Subscriptions are billed monthly or annually based on your selection
• All fees are exclusive of taxes unless stated otherwise
• Payment processing is handled securely through Stripe
• Prices are subject to change with 30 days notice

4.3 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellations take effect at the end of the current billing period
• No refunds for partial months or unused credits
• Free trial users may cancel before trial end to avoid charges

5. Acceptable Use Policy

5.1 Permitted Uses

You may use BlinkPost only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

• Violate any laws, regulations, or third-party rights
• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Generate spam, misleading, or deceptive content
• Infringe on intellectual property rights of others
• Impersonate any person or entity
• Use the service to harm minors in any way
• Transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems
• Reverse engineer or decompile any part of the service
• Scrape, crawl, or use automated tools to access the service
• Resell or redistribute our service without permission
• Share your account credentials with others
• Circumvent usage limits or access controls
• Generate content that violates social media platform policies

6. Content Ownership and Rights

You retain ownership of all content you create using BlinkPost. By using our service, you grant us a limited, non-exclusive license to:

• Process your inputs through AI models to generate content
• Store your generated content for service delivery
• Use anonymized, aggregated data to improve our services

6.2 AI-Generated Content

Content generated by our AI models is provided for your use, subject to:

• You are responsible for reviewing and editing AI-generated content before publication
• AI-generated content may not be unique and could be similar to content created for other users
• You must comply with third-party AI provider terms (OpenAI, Google)
• BlinkPost makes no warranties about the accuracy or suitability of AI-generated content

6.3 BlinkPost Intellectual Property

BlinkPost and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

7. Social Media Integration

7.1 Third-Party Platforms

When you connect social media accounts (LinkedIn, Facebook, Instagram), you:

• Authorize BlinkPost to access your account according to granted permissions
• Agree to comply with each platform's terms of service and policies
• Understand that platforms may change their APIs or policies at any time
• Can revoke access at any time through your account settings

7.2 Content Publishing

You are solely responsible for content posted to your social media accounts through BlinkPost. We are not liable for any consequences resulting from published content.

7.3 Rate Limits

BlinkPost implements platform safety rate limits to protect your accounts from shadowbans:

• Instagram: Maximum 3 posts per day
• Facebook: Maximum 5 posts per day
• LinkedIn: Maximum 2 posts per day
• Twitter: Maximum 10 posts per day

8. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

BlinkPost is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or reliability of AI-generated content
• Compatibility with all social media platforms
• That defects will be corrected
• Freedom from viruses or harmful components

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLINKPOST SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions or data loss
• Content posted to social media platforms
• Third-party services or integrations
• Account suspensions on social media platforms

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9.3 AI-Generated Content Disclaimer

AI-generated content may contain inaccuracies, biases, or inappropriate material. You are solely responsible for reviewing, editing, and approving all content before publication.

10. Indemnification

You agree to indemnify, defend, and hold harmless BlinkPost, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the service
• Content you publish through BlinkPost
• Violation of these Terms
• Violation of any third-party rights
• Your breach of any laws or regulations

11. Termination

11.1 By You

You may terminate your account at any time by contacting us or using account settings.

11.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the service in a harmful manner
• Violate third-party platform policies

11.3 Effect of Termination

Upon termination:

• We may delete your account data after 30 days
• You remain liable for any outstanding fees
• Provisions that should survive termination will remain in effect
